DDI262 – Fundamental Rights in Comparative Perspective: Brazil-USA

In this course, we will cover fundamental rights as seen by the American and the Brazilian Supreme Courts. We will examine substantive due process; desegregation; race and gender discrimination; affirmative action; free expression; religious freedom; the right to privacy; and the constitutional significance of the welfare state.

One aim of our class will be for you to learn the fundamental principles and doctrines of American and Brazilian constitutional law with the goal of analyzing and commenting on these doctrines and principles in the context of particular cases. Throughout the class, you will also continue to build your skills in legal analysis, discussion, and critical thinking through your reading and class discussion. We will tease out and examine intertwined normative and political positions in constitutional jurisprudence.
